2.Definitions and Interpretation

2.1All capitalised words and expressions used in this Statement shall, unless (a) specifically defined below or in any other place herein or (b) the context otherwise requires, have the meanings given to them in the User Agreement:

Cookies” means small strings of data that the Website, when Used by a User, sends to the User’s web browser and are stored on the User’s device;

Google” means Google Inc. of 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (together with other companies of the Google group); and

Web Storage” means the Web storage methods of the User’s browser which allows to store certain data on the User’s device which can be used by the Website without them being accessible by the Website’s server and database.

2.2References to “include” or “including” are to be construed without limitation.

2.3References to a “person” include any individual, company, partnership, joint venture, firm, association, trust, governmental or regulatory authority or other body or entity (whether or not having separate legal personality).

2.4The table of contents and headings are inserted for convenience only and do not affect the construction of this Statement.

2.5Unless the context otherwise requires, words in the singular include the plural and vice versa and a reference to any gender includes all other genders.

3.Why the Website Utilises Cookies and Similar Technologies

3.1The Website uses essential first party Cookies (i.e. Cookies directly set by the Website), which are required for technical reasons in order for the Website to operate normally.

3.2In addition to the essential first party Cookies, the Website also uses additional first party Cookies generated by Google Analytics. Google Analytics, developed by Google, is the most popular web analytics service. These Cookies are essential to undertake private and non-commercial analytical research about the Website’s traffic to understand and optimise the Website’s Usage and demographics.

3.3The Website also uses Web Storage to store various User settings and preferences on his or her device and allow the Website to display according to these settings and preferences. Unlike Cookies, the data stored on the Web Storage are accessible on the User’s device and are not transferred to otherwise recorded on the Website’s database.

3.4In some cases these technologies also collect information which may qualify as personal data of the Users. Please refer to the Privacy Policy for more details on how the Website collects and otherwise processes personal data of the Users.

5.Additional First Party Cookies

5.1The following Cookies are deployed by the Website when a User leaves a comment and choses the option to save his or her name and email address for future comments. These Cookies are necessary for the Website to enable this option by identifying the User and remember the name and email address the User provided for future automatic display in the comment form.

On each page load, the Website checks this value and enables or disables enhanced contrast accordingly.

On each page load, the Website checks this value and displays with small, medium or large font size accordingly.

Local Storage This data is created and stored when the User clicks “Accept” on the popup remining him or her to review and accept the User Agreement.

The data will be kept, and the popup will not reappear, until the User clears the Local Storage of his or her browser.

Session Storage This data is created and stored when the User clicks “Dismiss” on the popup remining him or her to review and accept the User Agreement.

The data will be kept, and the popup will not reappear, until the User closes the Website.

7.User’s Consent

7.1By Using the Website, the User understands the necessity of the Cookies, Web Storage and similar technologies and agrees with their generation and storage.

8.Cookies and Web Storage Control by the User

8.1Depending on the device and browser used, the User may limit, block, fully disable, temporarily or permanently reset any Cookies, as well as fully disable the Web Storage.

(a)Browser Controls: The User may set or amend his or her web browser controls to enable or disable Cookies and Web Storage.

(b)Do Not Track: Some Internet browsers include the ability to transmit “Do Not Track” or “DNT” signals. Since uniform standards for “DNT” signals have not been adopted, the Website does not currently process or respond to “DNT” signals.

(c)Google Analytics Opt-Out: The User may opt out from Google Analytics using the privacy setting of the Website (which requires the Web Storage functions be enabled on the browser) or using “Google Analytics Opt-Out Browser Add-on” available at https://tools.google.com/dlpage/gaoptout.

8.2However, if the User chooses to disable the Cookies and the Web Storage, the Website may not be outputted correctly or function normally on the User’s device.

9.Further Amendments

9.1The Author may amend, revise or otherwise change the terms and conditions of this Statement at any time without prior or subsequent notice, and such amended, revised or otherwise changed Statement shall take effect since the date immediately after the date of publication thereof on the Website.

10.Severability

10.1If any term or provision in this Statement shall be held to be illegal, invalid or unenforceable, in whole or in part, under any enactment or rule of law, such term or part shall to that extent be deemed not to form part of this Statement, but the legality, validity or enforceability of the remainder of this Statement shall not be affected.

11.Applicable Law and Dispute Resolution

11.1This Statement is subject to (a) the Applicable Law as defined in, determined in accordance with, the User Agreement and (b) the dispute resolution procedure set out in paragraph “Applicable Law and Dispute Resolution” of the User Agreement.

12.Language

12.1This Statement is made in the English and Russian languages and may be additionally published in other languages. In case of any discrepancy between the texts of this Statement in any two languages: (a) if the Applicable Law is the laws of the Russian Federation, the Russian text shall prevail; or (b) if the Applicable Law is not the laws of the Russian Federation, the English text shall prevail.
